2. Domestic Contract Review Fixed-Fee Review

Domestic Contract Review provides a lawyer-led fixed-fee review of HIA home building contracts and Master Builders home building contracts. A customer may complete an intake form, upload the construction contract pack, pay $699 including GST, and receive an owner review document and builder discussion document prepared and reviewed by an Australian solicitor.

3. Construction contract review scope

This fixed-fee review is limited to the home building contract and construction contract pack. It does not include review of a land purchase contract, land acquisition contract, conveyancing contract or property acquisition documents.

If land acquisition documents also need to be reviewed, that is separate work and can be quoted separately.

4. Scope of retainer and solicitor-client relationship

The submission of an intake form, upload of documents or payment of the fixed fee does not by itself create an ongoing solicitor-client relationship or retainer beyond the fixed-fee review.

The fixed-fee review is limited to the review of the information and documents provided by the customer and the preparation of the owner review document and builder discussion document. Any further advice, representation, drafting, negotiation, filing, correspondence, appearance or ongoing carriage of the matter requires a separate agreement or engagement.

5. Not full legal representation

The $699 Fixed-Fee Review is not full legal representation.

It does not include:

  • acting on the customer's behalf
  • contacting the builder
  • filing court or tribunal documents
  • appearing at a hearing
  • negotiating with the builder
  • drafting amendments, correspondence, pleadings, affidavits or detailed submissions
  • urgent injunction or emergency representation work
  • ongoing carriage of any dispute
  • open-ended follow-up advice

Further work requires a separate fixed-fee agreement or engagement.

6. No outcome guarantee

Domestic Contract Review does not guarantee any particular outcome, settlement, court result, tribunal result, recovery, defence, negotiation outcome or legal result.

Any review is based on the information and documents provided by the customer at the time of review.

7. Information provided by customers

The usefulness of the review depends on the accuracy, completeness and relevance of the information and documents provided.

If important facts or documents are missing, incomplete, inaccurate, unclear or illegible, the assessment may be limited or may need to be revisited.

Domestic Contract Review may decline to provide a review, or refund the fixed fee, if the matter is unsuitable, outside scope, affected by conflict, insufficiently documented, abusive, unlawful, or otherwise inappropriate for the service.

8. Deadlines and urgent matters

Domestic Contract Review aims to provide the review within 48 hours after payment and receipt of complete usable material.

Customers remain responsible for protecting their own position and complying with any deadlines unless Domestic Contract Review or another lawyer expressly agrees to take further action.

The Fixed-Fee Review does not include urgent representation or emergency legal action.

9. Jurisdiction and professional obligations

Domestic Contract Review is intended for Australian domestic contract matters and Australian users.

The service is subject to any mandatory professional obligations applying to the solicitor or legal practice providing the service.

Domestic Contract Review is a standalone fixed-fee domestic building contract review platform.

Reviews are prepared and reviewed by an Australian solicitor.

10. Further advice

Customers should obtain further legal advice before taking or refraining from action where:

  • the matter is urgent
  • formal proceedings or a live building dispute are involved
  • large sums are at stake
  • rights may be lost
  • a deadline applies
  • the matter involves serious property, consumer, tribunal or commercial consequences
  • the customer does not understand the written review
